One of the most common misunderstandings following cannabis legalisation is the assumption that cannabis may now be possessed and consumed anywhere and at any time. The KCanG creates significant freedoms but also defines precisely which quantities are permitted where and which locations remain off-limits for consumption.
## Possession Limits
Adults aged 18 and over may carry up to 25 grams of dried cannabis in public spaces (streets, parks, public transport, shopping centres). At home or on private property, up to 50 grams may be stored. The higher private limit reflects the reduced risk of accidental distribution in a controlled setting.
## Consumption Exclusion Zones
Cannabis consumption is prohibited within 100 metres of schools, childcare facilities, public playgrounds, public sports facilities and youth centres. The distance is measured as the crow flies and applies around the clock, seven days a week. Consumption in pedestrian zones is additionally banned between 07:00 and 20:00. Consuming cannabis in the visible presence of minors is prohibited regardless of location.
## Police Controls
Carrying cannabis within legal limits does not in itself give police grounds for suspicion. If stopped, identify yourself, cooperate calmly and present your cannabis if asked. You are not obliged to explain where the cannabis came from. If the legal limit is not exceeded and no consumption offence has occurred, there is no basis for confiscation.
## Transporting Cannabis in a Vehicle
Drivers may carry cannabis in their vehicle (within the 25-gram limit) but must ensure their THC blood level is below 3.5 ng/ml. Cannabis should be stored out of immediate reach – preferably in the boot – to avoid any appearance of imminent consumption. Passengers may carry their own legal quantities. Consumption inside a vehicle on public roads is prohibited for everyone in the vehicle.
## Cross-Border Travel
Cannabis may not be taken out of Germany, even to other EU countries. Domestic travel between German states is governed by the uniform KCanG rules.
## Practical Tips
In public parks, consumption is legal provided no exclusion zone is active and no minors are present nearby. On private balconies, consumption is generally permitted, though strong odours may raise tenancy or neighbour-law issues. Workplace consumption is governed by the employer's house rules. Festival rules depend on whether the venue is public or private.
